Desde el comienzo de la industria de la producción animal, el uso de antibióticos como promotores de crecimiento (APC) ha hecho posible el desarrollo de sistemas intensivos de producción animal; sin embargo, esta práctica ha sido cuestionada por organismos de salud pública y consumidores, por la posible prevalencia de bacterias resistentes y la potencial falla terapéutica de antibióticos en humanos y animales (Knarreborg et ál., 2004; Mathew et ál., 1998). Año tras año el uso de APC en el alimento de los animales se ha venido restringiendo en diversos países; por ejemplo, la Unión Europea, bajo un principio de precaución, prohibió el uso de APC a partir de 2006. Se afirma que esta prohibición, aparentemente, ha acarreado una reducción del comportamiento productivo de los animales; sin embargo, las experiencias de países como Suecia sugieren que es posible alcanzar unos índices de producción con altos rendimientos y competitividad sin el uso de APC; aplicando al proceso productivo unas buenas condiciones de manejo. En este sentido, la Organización Mundial de la Salud (OMS) valora esta experiencia y concluye que se puede prescindir de los APC "en condiciones de producción similares a las suecas" (Organización Mundial de la Salud, 2001). A pesar de las implicaciones negativas en la salud pública del uso de APC, países como Colombia y Estados Unidos aún siguen utilizando fármacos como promotores de crecimiento de manera indiscriminada; pero la apertura económica a mercados mundiales a raíz de los recientes tratados de libre comercio plantea el reto y la necesidad de eliminar este tipo de prácticas.

This book investigates whether treaty interpretation at the ECtHR and WTO, which are sometimes perceived as promoting ‘self-contained’ regimes, could constitute a means for unifying international law, or, conversely, might exacerbate the fragmentation of international law. In this regard, the practice of the ICJ on treaty interpretation is used for comparison, since the ICJ has made the greatest contribution to the development and clarification of international law rules and principles. Providing a critical analysis of cases at the ICJ, ECtHR and WTO, both prior to and since the adoption of the 1969 Vienna Convention on the Law of Treaties, the book reveals how the ECtHR and WTO apply the general rules of treaty interpretation in patterns which are similar to those used by the ICJ to address difficulties in interpreting the text of treaties. Viewed in the light of the ECtHR’s and WTO’s interpretative practices, both the VCLT’s general rules of interpretation and the ICJ’s interpretative practice serve to counteract the fragmentation of international law.
